Ground and Facts for Divorce

The only ground for divorce in Singapore is the irretrievable breakdown of the marriage. To show that the marriage has irretrievably broken down, you need to prove ONE of the six possible situations as laid down in s 95(3) of the Women’s Charter.

That is:

  • Adultery and Intolerability,
  • Unreasonable Behaviour,
  • Desertion for 2 years,
  • Living Apart (for 3 years with consent, or living apart for 4 years)
  • Mutual Agreement
The most commonly relied on reason is the unreasonable behaviour of the other spouse.
